Allgemeine Geschäftsbedingungen (AGB) für Workshops

(nachfolgend “die Veranstalterin”)

1. Geltungsbereich

Diese Allgemeinen Geschäftsbedingungen (AGB) regeln das Vertragsverhältnis zwischen der Veranstalterin und den Teilnehmer:innen (nachfolgend Teilnehmer) für Fotografie-Workshops, Coachings und Schulungen, die von annemanke.com Photography angeboten werden.

Abweichende Vereinbarungen bedürfen der schriftlichen Form.

 

2. Anmeldung und Vertragsabschluss

  1. Die Anmeldung zu einem Workshop erfolgt über das Online-Anmeldeformular auf annemanke.com oder schriftlich per E-Mail.
  2. Mit Absenden der Anmeldung erklärt sich der Teilnehmer verbindlich zur Teilnahme am ausgewählten Workshop.
  3. Der Vertrag kommt erst mit der schriftlichen oder elektronischen Buchungsbestätigung durch die Veranstalterin zustande.
  4. Die Teilnehmerzahl ist begrenzt. Die Plätze werden in der Reihenfolge des Zahlungseingangs vergeben.

 

3. Preise und Zahlungsbedingungen

  1. Die im jeweiligen Workshop-Angebot angegebenen Preise verstehen sich in Schweizer Franken (CHF), inklusive Mehrwertsteuer, sofern anwendbar.
  2. Die Zahlung ist innerhalb von 14 Tagen nach Erhalt der Buchungsbestätigung fällig.
  3. Erst nach vollständigem Zahlungseingang ist der Workshop-Platz verbindlich reserviert.
  4. Bei nicht fristgerechter Zahlung kann der Platz ohne weitere Mitteilung an andere Teilnehmer vergeben werden.

 

4. Rücktritt durch den Teilnehmer

  1. Ein Rücktritt muss schriftlich per E-Mail erfolgen.
  2. Bei Stornierung gelten folgende Gebühren:
    • bis 30 Tage vor Workshop-Beginn: kostenfrei
    • bis 14 Tage vor Workshop-Beginn: 50 % der Workshop-Gebühr
    • weniger als 14 Tage vor Beginn oder bei Nichterscheinen: 100 % der Gebühr
  3. Der Teilnehmer kann im Einvernehmen mit der Veranstalterin eine Ersatzperson benennen, die den Platz übernimmt.
  4. Eine Rückerstattung bei verspätetem Erscheinen oder vorzeitigem Verlassen des Workshops ist ausgeschlossen.

 

5. Rücktritt oder Änderungen durch die Veranstalterin

  1. Die Veranstalterin behält sich das Recht vor, Workshops aus wichtigen Gründen (z. B. Krankheit, zu geringe Teilnehmerzahl, höhere Gewalt) abzusagen oder zu verschieben.
  2. In diesen Fällen werden bereits geleistete Zahlungen vollständig zurückerstattet.
  3. Weitere Ansprüche (z. B. auf Schadenersatz oder Ersatz von Reisekosten) sind ausgeschlossen.

 

6. Workshop-Inhalte und Ablauf

  1. Der Inhalt und Ablauf des Workshops können aus didaktischen oder organisatorischen Gründen angepasst werden, sofern der Gesamtcharakter des Workshops gewahrt bleibt.
  2. Die Veranstalterin stellt sämtliche Studioblitze, Lichtformer und erforderliches Equipment zur Verfügung.
  3. Die Teilnehmer sind für ihre eigene Kameraausrüstung verantwortlich.

 

7. Haftung

  1. Die Teilnahme erfolgt auf eigene Gefahr und Verantwortung.
  2. Die Veranstalterin haftet nur bei vorsätzlicher oder grob fahrlässiger Pflichtverletzung.
  3. Für Unfälle, Sach- oder Personenschäden während des Workshops sowie für den Verlust oder die Beschädigung von mitgebrachter Ausrüstung übernimmt die Veranstalterin keine Haftung.
  4. Teilnehmer sind für ausreichenden Versicherungsschutz (z. B. Unfall-, Haftpflicht- oder Geräteschutzversicherung) selbst verantwortlich.

 

8. Urheberrechte

  1. Sämtliche Unterlagen, Präsentationen, Fotos, Videos und sonstigen Inhalte des Workshops sind urheberrechtlich geschützt.
  2. Eine Vervielfältigung, Veröffentlichung oder Weitergabe an Dritte ist ohne ausdrückliche Zustimmung der Veranstalterin nicht gestattet.
  3. Fotos, die im Rahmen des Workshops entstehen, dürfen von den Teilnehmern für private oder Portfoliozwecke verwendet werden, jedoch nicht für kommerzielle Werbung, sofern nicht ausdrücklich schriftlich erlaubt.

 

9. Datenschutz

  1. Die Veranstalterin verarbeitet personenbezogene Daten ausschließlich im Rahmen der gesetzlichen Datenschutzbestimmungen (DSG/DSGVO).
  2. Die Daten werden ausschließlich zur Abwicklung der Buchung und Workshop-Kommunikation verwendet.
  3. Eine Weitergabe an Dritte erfolgt nicht, außer wenn gesetzlich erforderlich.

 

10. Bild- und Tonaufnahmen durch die Veranstalterin

Während des Workshops können durch die Veranstalterin oder deren Beauftragte Fotos oder Videos zur Dokumentation und Eigenwerbung gemacht werden.

Teilnehmer, die damit nicht einverstanden sind, müssen dies vor Workshopbeginn schriftlich mitteilen.

 

11. Gerichtsstand und anwendbares Recht

  1. Es gilt Schweizer Recht unter Ausschluss des UN-Kaufrechts (CISG).
  2. Gerichtsstand ist Küssnacht am Rigi, Schweiz.

 

12. Salvatorische Klausel

Sollten einzelne Bestimmungen dieser AGB unwirksam sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

Anstelle der unwirksamen Regelung tritt eine gültige Bestimmung, die dem wirtschaftlichen Zweck am nächsten kommt.

Terms and Conditions (T&C) for Photography Workshops

(hereinafter referred to as “the Organizer”)

1. Scope of Application

These Terms and Conditions apply to all photography workshops, coaching sessions, and educational events (hereinafter referred to as “workshops”) organized and conducted by annemanke.com Photography.

Any agreements that deviate from these terms must be confirmed in writing.

 

2. Registration and Conclusion of Contract

  1. Registration for a workshop must be made via the online registration form on the Organizer’s website or in writing via email.
  2. By submitting the registration, the participant makes a binding offer to attend the selected workshop.
  3. A contract is formed only upon written or electronic confirmation from the Organizer.
  4. Workshop spots are limited and are allocated in the order of payment received.

 

3. Prices and Payment Terms

  1. All workshop prices are stated in Swiss Francs (CHF) and include VAT, where applicable.
  2. The workshop fee must be paid within 14 days of receiving the booking confirmation.
  3. A participant’s place is only guaranteed after full payment has been received.
  4. If payment is not made on time, the Organizer reserves the right to release the reserved place to another participant.

 

4. Cancellation by the Participant

  1. Cancellations must be made in writing via email.
  2. The following cancellation fees apply:
    • Up to 30 days before the workshop: free of charge
    • Up to 14 days before the workshop: 50% of the workshop fee
    • Less than 14 days before or in case of no-show: 100% of the workshop fee
  3. A substitute participant may be named with prior agreement of the Organizer.
  4. No refunds will be given for late arrivals, early departures, or missed parts of the workshop.

 

5. Cancellation or Changes by the Organizer

  1. The Organizer reserves the right to cancel or reschedule workshops for important reasons (e.g., illness, insufficient participants, force majeure).
  2. In such cases, any payments already made will be fully refunded.
  3. Any further claims (e.g., for travel or accommodation costs) are excluded.

 

6. Workshop Content and Equipment

  1. The Organizer reserves the right to modify the workshop structure or content for educational or organizational reasons, as long as the overall purpose of the workshop remains intact.
  2. All studio lights, light modifiers, and other necessary equipment are provided by the Organizer.
  3. Participants are responsible for bringing and handling their own camera gear.

 

7. Liability

  1. Participation is at the participant’s own risk.
  2. The Organizer is only liable for damages caused by intentional or grossly negligent conduct.
  3. The Organizer assumes no liability for accidents, property damage, personal injury, or loss of personal equipment.
  4. Participants are responsible for their own insurance coverage (accident, liability, equipment insurance, etc.).

 

8. Copyright and Intellectual Property

  1. All materials, presentations, photographs, and workshop content are protected by copyright.
  2. Any duplication, distribution, or commercial use without written consent from the Organizer is prohibited.
  3. Photos taken during the workshop may be used by participants for personal portfolios and educational purposes only, unless otherwise agreed in writing.

 

9. Data Protection

  1. The Organizer processes personal data in accordance with Swiss data protection law (DSG) and, where applicable, the EU General Data Protection Regulation (GDPR).
  2. Personal information is used solely for workshop administration and communication.
  3. Data will not be shared with third parties unless required by law.

 

10. Image and Video Recordings by the Organizer

Photos and/or videos may be taken during the workshop for documentation or promotional purposes.

Participants who do not agree to appear in such materials must notify the Organizer in writing prior to the workshop.

 

11. Governing Law and Jurisdiction

  1. These Terms and Conditions are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
  2. The exclusive place of jurisdiction is Küssnacht am Rigi, Switzerland.

 

12. Severability Clause

If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions shall remain in full force and effect.

An invalid clause shall be replaced by one that most closely reflects the original intent and purpose.
